SPHYNX Properties Terms and Conditions set out the rules for using our website, viewing or listing property, engaging our estate agency, and working with our management and advisory teams. Because we serve clients in Accra and beyond, these Terms are written in plain English, aligned to Ghanaian law, and considerate of international best practice.
1. Acceptance of Terms
By accessing our website, booking a viewing, listing a property, or engaging any service, you agree to be bound by these SPHYNX Properties Terms and Conditions. If you do not accept the Terms, do not use our services. Where you sign a service agreement, that agreement prevails if there is any conflict.
2. Definitions
- “SPHYNX”, “we”, “us” means SPHYNX Limited (Ghana), trading as SPHYNX Properties.
- “Client”, “you” means any person or entity using our website or services.
- “Services” means agency (sales/lettings), property management, valuation, consultancy, and related activities.
- “Site” means sphynx-properties.com and associated pages.
3. Scope of Services
3.1 Sales & Lettings
We market properties, facilitate viewings, handle offers, and liaise between parties until completion or tenancy commencement.
3.2 Property Management
We offer tenant management, rent collection, maintenance coordination, and periodic reporting under a written mandate.
3.3 Valuation & Advisory
We provide market opinions and guidance. Formal valuations are issued by qualified professionals where applicable.
3.4 Relocation Support
We coordinate with trusted partners for moving, settling-in, and related logistics in Accra and surrounding areas.
4. Client Responsibilities
- Provide accurate, complete, and timely information.
- Ensure access for viewings and inspections when agreed.
- Comply with applicable laws, permits, and community rules.
- Notify us of any material change to property condition or title.
5. Listings & Viewings
We may edit, prioritise, or remove listings that breach policy or law. We take reasonable care with property descriptions and images, yet details are provided “as is” and subject to verification by prospective buyers or tenants. Viewings are by appointment; identification may be required.
6. Offers & Transactions
We present offers promptly and fairly. Unless agreed otherwise, offers are “subject to contract and due diligence.” Clients and customers should seek independent legal, tax, and technical advice before entering binding agreements.
7. Fees & Payment
Fees, commissions, and payment timing are set out in our written mandates or engagement letters. Where applicable, taxes (e.g., VAT/NHIL) are charged in addition. Invoices are due on receipt unless a different schedule is agreed in writing.
8. Property Management
Management terms are defined in the management agreement (service scope, float levels, approval limits, and reporting cadence). Emergency works may be authorised per the agreement to protect life, health, or property.
9. AML/KYC & Compliance
We follow Anti-Money Laundering (AML) and Know-Your-Customer (KYC) requirements. We may request ID, address, and source-of-funds documents and decline or discontinue services where obligations are not met.
10. Privacy & Data Protection
We respect privacy and process personal data lawfully and transparently. See our Privacy Policy for details, including your rights and our retention practices. We align our controls with Ghana’s data protection regime and international good practice.
11. Marketing & Intellectual Property
- Our Site and materials are protected by copyright and related rights.
- You may not copy, scrape, or republicise listings without consent.
- Where you supply content (text, images), you grant us a non-exclusive licence to use it for marketing during our instruction.
12. Third-Party Services & Links
We may reference third-party websites or service providers for convenience. They operate independently; we are not responsible for their content or performance. For regulatory context, see (example): Ghana Data Protection Commission.
13. Warranties & Disclaimers
Services are provided with reasonable skill and care. Except where prohibited by law, we disclaim all other warranties, express or implied, including merchantability and fitness for a particular purpose. Market data and forecasts are indicative and may change.
14. Liability & Indemnity
We are not liable for indirect or consequential loss (including loss of profits, revenue, or business). To the fullest extent permitted by law, our aggregate liability for claims arising out of or in connection with the Services is limited to the total fees paid to us for the specific instruction giving rise to the claim. You agree to indemnify us against claims arising from your breach of these Terms or applicable law.
15. Force Majeure
Neither party is liable for delays or failure to perform due to events beyond reasonable control (including but not limited to extreme weather, infrastructure outages, labour disputes, acts of government, war, or epidemics).
16. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Ghana. Courts in Accra have exclusive jurisdiction. Parties will first attempt to resolve disputes amicably and in good faith before litigation.
17. Changes to These Terms
We may update these Terms to reflect legal, operational, or service changes. The revision date above will indicate the latest version. Material changes will be signposted on this page.
